This Rental Agreement ("Agreement") is made and entered into by and between Bouncy Bear Rentals ("Company") and the Renter ("Customer") for the rental of bounce houses ("Equipment"). By signing this Agreement or by using the Equipment, Customer agrees to be bound by the terms and conditions outlined herein:
1. Rental Period:
The rental period begins on the agreed-upon delivery date and ends on the scheduled pickup date.
Any extension of the rental period must be approved by the Company in advance.
2. Delivery and Setup:
The Company will deliver, set up, and inspect the Equipment at the designated location specified by the Customer.
Customer must provide clear access to the delivery location and ensure that the setup area is free of obstacles and debris.
3. Supervision:
A responsible adult must supervise the Equipment at all times during the rental period.
Customer is responsible for ensuring that all users follow the safety rules and guidelines provided by the Company.
4. Use of Equipment:
The Equipment shall only be used for its intended purpose and in accordance with the manufacturer's instructions.
Customer shall not alter, modify, or tamper with the Equipment in any way.
5. Care and Maintenance:
Customer agrees to use the Equipment in a careful and proper manner.
Customer shall not attempt to repair or clean the Equipment without the Company's authorization.
6. Weather Conditions:
Customer shall not use the Equipment during inclement weather, including rain, strong winds, or lightning.
In the event of adverse weather conditions, Customer must immediately cease use of the Equipment and seek shelter.
7. Payment and Fees:
Customer agrees to pay the rental fee, delivery fee, and any other applicable charges specified by the Company.
Payment is due in full prior to the setup of the Equipment.
Additional fees may apply for late returns, damage to the Equipment, or violations of this Agreement.
8. Liability Waiver:
Customer assumes all risks and liabilities associated with the use of the Equipment.
Customer agrees to release, indemnify, and hold harmless the Company from any claims, damages, or injuries arising from the use of the Equipment.
9. Cancellation and Refunds:
Cancellation requests must be made in writing at least 48 hours prior to the scheduled delivery date.
Refunds will be issued in accordance with the Company's cancellation policy.
10. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the state of Michigan. By signing below, Customer acknowledges that they have read and understood the terms and conditions of this Agreement and agree to be bound by them.
